Stories of Cruel Injustice in Thailand: when the Supreme Court forces Poor Villagers into extreme poverty, because of bad Forest conservation laws created by the 1% Rich!

Unfair Court Decisions: Last week. the last Supreme Court’s verdicts were pronounced for the remaining Sab Wai villagers who have all been unfairly found guilty of encroaching and destroying the forest in Sai Thong National Park, due to the bad implementation of the Forest Reclamation Policy . The Sab Wai villagers have been fighting for justice for more than 6 years to prove they are “PROTECTORS '' of the forest, for their right to peacefully live and cultivate sustainable crops on the land. But the Thai Supreme Court still put Sompitr, Pattama, and Sakl in jail, while putting the 11 other villagers on probation with 3-years of suspended jail term!

Extreme Poverty : All Sab Wai Villagers have to pay heavy civil penalties and might be evicted from their land! to compensate the Department of National Park. In total, they have to pay 5,716,229 Thai Baht ($ 182,359 USD) of fines to the government! THIS IS INSANE! How can they pay that amount, they are already poor villagers!! In addition to the crazy heavy fines, the Sab Wai Villagers were put in heavy debt when they were sent to jail for many months in 2019, due to the Appeals Court decisions! Who will give them their life back?

But the truth is, none of them should have been charged and even convicted in the first place! Because they are NOT guilty! For generations, they have been protecting the forest, thanks to their sustainable ways of cultivating land - but the Thai government and the 1% are too ignorant and bias to recognize that.

Although 11 villagers are walking free, it is still so unfair and disheartening to see that 3 of them are now in jail, leaving their families behind! Remember their fight, Remember their names:

#SaveSompitr - He is now in jail because the Supreme Court considers him a recidivist as he was convicted before due to the bad forest conservation laws. After his jail term, he had nowhere else to go, other than returning to his own land and defending his right to live in his own home. How is that even a crime ? Remember that he is leaving behind his wife, with stage 4 cancer. Yes, Thailand’s justice system is so cruel.

#SavePattama and #SaveSakl - the 2 women villagers are in jail because the Court wrongly viewed them as investors, simply because they own more than 25 rai of land (4 Hectares or 0.4 Square KM). But they are not investors! These lands are all they have to sustain their families! These aren’t just one branch of their businesses where they invested by building a resort, or constructing a huge farm and getting huge profits in return.

เป็นอีกครั้งที่ความไม่เป็นธรรมเกิดขึ้นในสังคมไทย ศาลฎีกาพิพากษาปิดฉาก #คดีไทรทอง ด้วยการตัดสินให้ทุกคนมีความผิด ทั้งยังบังคับจ่ายค่าปรับอีกรวมหลายล้าน ผลักให้ทุกคนต้องเป็นหนี้และยากจนลงยิ่งกว่าเดิม ทั้งหมดนี้เป็นเพราะกฎหมายป่าไม้ที่ไม่เป็นธรรมและไม่สอดคล้องกับความเป็นจริง!

เมื่อสัปดาห์ที่แล้ว ได้มีการอ่านคำพิพากษาศาลฎีกาของชาวบ้านซับหวายกลุ่มสุดท้าย ซึ่งชาวบ้านซับหวายทั้ง 14 คนก็ยังคงถูกตัดสินให้มีความผิดฐานเป็นผู้บุกรุกทำลายป่าในเขตอุทยานแห่งชาติไทรทองตามการบังคับใช้นโยบายทวงคืนผืนป่าที่ไม่เป็นธรรม โดยชาวบ้านซับหวายทั้ง 14 คนได้ต่อสู้เพื่อทวงสิทธิในที่ดินทำกินของตัวเองกันมานานถึง 6 ปีและเพื่อพิสูจน์ว่าพวกเขาไม่ใช่นายทุนที่ทำลายป่า แต่เป็นผู้ปกป้องผืนป่าที่อยู่ร่วมกับธรรมชาติอย่างยั่งยืน

แต่สุดท้าย ศาลก็ตัดสินให้จำคุกชาวบ้าน 3 คนทันที คือ ลุงสมพิตร ปัทมาและสากล ส่วนอีก 11 คนศาลให้รอลงอาญาเป็นเวลา 3 ปี

ยิ่งไปกว่านั้น คำพิพากษาของศาลจะทำให้ทุกคนยิ่งลำบาก เพราะศาลตัดสินให้ชาวบ้านทุกคนต้องจ่ายค่าเสียหายฐานบุกรุกทำลายป่าให้กับกรมอุทยานคนละหลายแสน รวมทั้งหมดแล้ว 5,716,229 บาท! ทุกคนเป็นแค่ชาวบ้านธรรมดา ไม่ได้มีเงินมากมายอะไร จะไปเอาเงินที่ไหนมาจ่าย? และตลอดหลายปีมานี้ ทุกคนต้องต่อสู้ในชั้นศาล ต้องมาเป็นหนี้และติดคุกไปคนละหลายเดือนในชั้นศาลอุทธรณ์ ความเสียหายที่เกิดขึ้นกับชีวิตของทุกคน ใครจะเป็นคนชดใช้?

ที่ร้ายกว่านั้นคือ ทุกคนอาจจะต้องถูกบังคับให้ย้ายออกจากพื้นที่ ต้องเสียบ้าน เสียงาน ไม่เหลืออะไรแล้ว

ในความเป็นจริงแล้วไม่ควรมีใครถูกดำเนินคดีมาตั้งแต่ต้น เพราะชาวบ้านซับหวายไม่ได้ทำอะไรผิด ทุกคนอยู่ในพื้นที่มาตั้งแต่ก่อนรัฐบาลจะประกาศเป็นเขตอุทยาน ชาวบ้านได้อยู่ร่วมกับป่าอย่างยั่งยืนและทำหน้าที่เสมือนผู้ปกป้องผืนป่า แต่ภาครัฐกลับมองไม่เห็นความจริงข้อนี้และโยนความผิดให้ชาวบ้านว่าเป็นตัวการตัดไม้ทำลายป่า

แม้จะเป็นข่าวดีที่ชาวบ้าน 11 คนได้รับการรอลงอาญาไม่ต้องกลับไปติดคุกอีก แต่การที่ชาวบ้านอีก 3 คนที่ถูกพิพากษาให้จำคุกทันทีนั้นไม่ยุติธรรมเลย ทั้งสามคนต้องติดคุก ต้องทิ้งครอบครัวที่ตัวเองเป็นเสาหลักไว้ข้างหลัง โปรดอย่าลืมพวกเขา

#Saveสมพิตร ลุงสมพิตรต้องติดคุกเพราะศาลตัดสินว่าเคยมีความผิดฐานบุกรุกป่ามาก่อน แต่ลุงสมพิตรแค่อยู่ในที่ดินของตัวเอง แค่ทำมาหากินในที่ที่อยู่มาเป็นสิบๆปี ยิ่งกว่านั้น ตอนนี้ภรรยาของลุงสมพิตรกำลังป่วยเป็นมะเร็งระยะสุดท้าย แต่ลุงสมพิตรกลับต้องติดคุกโดยไม่เป็นธรรม ไม่ได้ดูแลภรรยา นี่หรือคือสิ่งที่ระบบยุติธรรมไทยมอบให้กับประชาชน?

#Saveปัทมา #Saveสากล พี่ปัทมากับพี่สากลก็เป็นชาวบ้านอีกสองคนที่ต้องติดคุก เนื่องจากถูกตัดสินจากการตีความกฎหมายว่าการถือครองที่ดินเกินกว่า 25 ไร่เข้าข่ายเป็นนายทุน ทั้งที่ความจริงแล้ว ที่ดินเหล่านี้เป็นพื้นที่สำหรับทำการเกษตรเพื่อหาเลี้ยงครอบครัว ที่ดินเหล่านี้คือบ้าน คืออาชีพ คือชีวิตทั้งชีวิตของพวกเขา ชาวบ้านไม่ใช่นายทุนที่มีที่ดินเป็นร้อยไร่เพื่อใช้ทำรีสอร์ท หรือทำฟาร์มเกษตรเชิงอุตสาหกรรม

ดังนั้นหากทุกท่านต้องการจะช่วยครอบครัวของลุงสมพิตรกับพี่ปัทมาเนื่องจากทั้งสองเป็นเสาหลักของบ้านก็สามารถร่วมกันบริจาคได้ หรือหากต้องการช่วยชาวบ้านคนอื่นๆที่ถึงแม้จะได้รอลงอาญา แต่ก็ยังต้องเป็นหนี้ก้อนใหญ่เนื่องจากถูกบังคับให้ชดใช้ค่าเสียหายฐานบุกรุกทำลายป่าให้กับรัฐบาล โดยแต่ละคนต้องจ่ายด้วยเงินเป็นจำนวนหลักแสน บางคนต้องถูกบังคับให้จ่ายด้วยจำนวนเกือบหลักล้านบาท
