Emilie Pradichit: #StopSLAPP: "The NAP is not bringing any change!"

🚨 The SLAPP (Strategic Lawsuit Against Public Participation) cases and threats against human rights defenders (HRDs), especially women HRDs who speak up to denounce human rights violations of the Thai government and companies in Thailand are very common to find. The previous cases of Premsinee Sintontammatuch & Nada Chaiyajit are only two of more than 450 cases of intimidation and harassment through SLAPPs targeting women HRDs since 2014.[1]


🗣️ "In the past 8 years, 450 women human rights defenders have been SLAPPed, facing judicial harassment in Thailand! The NAP is not bringing any change because it has zero anti-SLAPP measures in it, zero mandatory measures in it to protect us against corporations!", said Emilie Pradichit, Founder & Executive Director of Manushya Foundation in her powerful intervention on Thailand's NAP-BHR during the Asia-Pacific Responsible Business and Human Rights Forum in Bangkok last month. ✊


#StopNAPping❗ Thai NAP-BHR - the National Action Plan on Business and Human Rights - was supposed to be a policy strategy developed by the Government to protect against adverse human rights impacts by business enterprises. But in reality, NAP-BHR turned into an ineffective, napping document. It does not include any anti-SLAPP measures to protect human rights defenders from mal-intentioned corporations that violate the human rights of the local communities & marginalized groups in Thailand.


🚩 Manushya Foundation relentlessly fights together with the affected WHRDs against SLAPP charges by submitting complaints to the UN & campaigning for their protection. Women HRDs' legitimate human rights work is in line with the UN Declaration on Human Rights Defenders, adopted by Thailand! The Thai authorities must respect it!

🚨 คดี SLAPP (Strategic Lawsuit Against Public Participation) และการคุกคามนักปกป้องสิทธิมนุษยชน (HRDs) โดยเฉพาะต่อนักปกป้องสิทธิมนุษยชนสตรีที่ออกมาประณามการละเมิดสิทธิมนุษยชนของรัฐบาลไทยและธุรกิจนั้นพบได้ทั่วไปในประเทศไทย กรณีก่อนหน้านี้ของพรีมสินี สินทรธรรมทัช และ นาดา ไชยจิตต์ เป็นเพียงสองคดีจากทั้งหมด 450 คดีที่เป็นการข่มขู่และคุกคามผ่านการฟ้องคดีปิดปาก SLAPPs ที่มุ่งเป้าไปที่นักปกป้องสิทธิมนุษยชนสตรีนับตั้งแต่ปี 2014 [1]


🗣️ "ในช่วง 8 ปีที่ผ่านมา มีนักปกป้องสิทธิมนุษยชนสตรีกว่า 450 คน ถูกฟ้องคดีปิดปากและถูกคุกคามโดยกระบวนการยุติธรรมในประเทศไทย! แผนปฏิบัติการด้านสิทธิมนุษยชนและธุรกิจ NAP ไม่ได้ทำให้เกิดการเปลี่ยนแปลงใด ๆ เพราะไม่มีมาตรการต่อต้านการฟ้องคดีปิดปาก อีกทั้งยังไม่มีมาตรการบังคับใด ๆ มาปกป้องพวกเราจากการละเมิดสิทธิมนุษยชนของภาคธุรกิจ!" เอมิลี่ ประดิจิตร ผู้ก่อตั้งและผู้อำนวยการมูลนิธิมานุษยะได้ประกาศกร้าวในช่วงแสดงความคิดเห็นเกี่ยวกับแผนปฏิบัติการ NAP-BHR ของประเทศไทยในระหว่างการประชุม Asia-Pacific Responsible Business and Human Rights Forum ที่กรุงเทพฯ เมื่อเดือนที่ผ่านมา


#StopNAPping❗ แผนปฏิบัติการ NAP-BHR ของไทย - แผนปฏิบัติการระดับชาติว่าด้วยธุรกิจและสิทธิมนุษยชน - ควรจะเป็นกลยุทธ์เชิงนโยบายที่พัฒนาโดยรัฐบาลเพื่อป้องกันผลกระทบด้านสิทธิมนุษยชนที่ไม่พึงประสงค์จากภาคธุรกิจ แต่ในความเป็นจริงแผนปฏิบัติการ NAP-BHR กลับกลายเป็นเอกสารที่ไร้ประสิทธิภาพและไร้มาตรการต่อต้านการคุกคามดังกล่าว อีกทั้งแผนปฏิบัติการนี้ยังไม่มีมาตรการต่อต้านการฟ้องคดีปิดปากเพื่อปกป้องนักปกป้องสิทธิมนุษยชนจากภาคธุรกิจที่มีมุ่งร้ายจะละเมิดสิทธิมนุษยชนในชุมชนท้องถิ่นและกลุ่มคนชายขอบในประเทศไทย


🚩 มูลนิธิมานุษยะ จะต่อสู้อย่างไม่ลดละร่วมกับนักปกป้องสิทธิมนุษยชนสตรีที่ได้รับผลกระทบต่อการถูกฟ้องคดีปิดปากโดยการยื่นเรื่องร้องเรียนต่อสหประชาชาติและร่วมรณรงค์เพื่อให้พวกเขาได้รับการคุ้มครอง เพราะการดำเนินการด้านสิทธิมนุษยชนที่ถูกกฎหมายของนักปกป้องสิทธิมนุษยชนสตรีนั้นสอดคล้องต่อปฏิญญาสหประชาชาติว่าด้วยนักปกป้องสิทธิมนุษยชนที่ประเทศไทยได้ให้การรับรอง! ดังนั้นทางการไทยจะต้องเคารพต่อปฏิญญาฉบับนี้!
