📣#FightRacism กระบวนการทบทวนสถานการณ์การขจัดการเลือกปฏิบัติทางเชื้อชาติ (CERD Review) ของประเทศไทย ณ สหประชาชาติ ได้สิ้นสุดลงแล้วในเมื่อกลางเดือนพฤศจิกายนที่ผ่านมา โดยทางคณะกรรรมการว่าด้วยการขจัดการเลือกปฏิบัติทางเชื้อชาติ(CERD Committee)และผู้เชี่ยวชาญจากสหประชาชาติหลายท่านได้หยิบยกหลากหลายประเด็นที่ทางมูลนิธิมานุษยะได้นำเสนอไปขึ้นมาถกอย่างเผ็ดร้อนระหว่างการประชุม! ✊🏼มาร่วมอ่านการต่อสู้ของเราได้ที่นี่!

📍ตลอด 4 ปีที่ผ่านมานับตั้งแต่มูลนิธิฯได้เปิดตัวขึ้นในปี 2560 พวกเราทำงานอย่างหนักร่วมกับชุมชนต่างๆทั่วประเทศเพื่อจับตาสถานการณ์สิทธิมนุษยชนของไทย กระบวนการ CERD Review ณ สหประชาชาติ จึงเป็นโอกาสสำคัญให้เราได้ช่วยผลักดันเสียงจากชุมชน #VoicesOfThailand และปัญหาการถูกเลือกปฏิบัติของพวกเขาไปสู่เวทีโลก

✊🏼ทางมูลนิธิฯได้ส่งรายงานร่วมภาคประชาสังคม (Joint Civil Society Shadow Report) ให้คณะกรรมการฯสำหรับกระบวนการCERD Review และประสานงานพูดคุยกับหน่วยงานที่เกี่ยวข้องกับกระบวนการนี้ ณ กรุงเจนีวา ประเทศสวิสเซอร์แลนด์ เพื่อผลักดันให้ประเด็นปัญหาต่างๆที่ถูกรัฐบาลไทยมองข้ามมาเป็นเวลานานได้เข้าไปอยู่ในวาระการถกเถียงของเวทีสิทธิมนุษยชนของสหประชาชาติ โดยระหว่างการประชุมของกระบวนการCERD Review ที่กรุงเจนีวา เราได้นำเสนอข้อมูล Evidence-based data เกี่ยวกับการเลือกปฏิบัติทางเชื้อชาติในไทยและเรื่องราวประสบการณ์จริงที่ชุมชนในพื้นที่ต้องพบเจอให้แก่คณะกรรมการฯ เพื่อเรียกร้องให้รัฐบาลไทยแสดงความรับผิดชอบต่อทุกเหตุการณ์ที่เกิดขึ้น!

“เราขอเรียกร้องให้คณะกรรรมการ CERD Committeeทุกท่าน อย่าทอดทิ้งพี่น้องชาวอีสานไว้เบื้องหลัง เราขอให้ท่านส่งเสียงร้องถามถึงพวกเขาและให้ข้อสังเกตุเชิงสรุป (Concluding Observations) ที่ชาวอีสานต้องการ ด้วยเราหวังว่า สักวันหนึ่งคนอีสานจะได้รับความยุติธรรมหลังจากพวกเขาต้องถูกดูถูกและเลือกปฏิบัติมาเป็นเวลานาน เราหวังว่า สักวันหนึ่ง ชาวนาผู้ปกป้องผืนป่า หรือแม้แต่กลุ่มผู้บริการทางเพศจากอีสานจะได้รับการปฏิบัติอย่างเท่าเทียมเป็นธรรม หลังจากที่พวกเขาถูกผลักไปอยู่ชายขอบของสังคมราวกับเป็นอาชญากร ท่านมีอำนาจอยู่ในกำมือของท่านที่จะช่วยให้ชาวอีสานได้รับการปฏิบัติเฉกเช่นมนุษย์ที่เท่าเทียมกันเสียที” Emilie Pradichit ผู้ก่อตั้งและผู้บริหารมูลนิธิมานุษยะ กล่าวระหว่างการประชุมระหว่างคณะกรรมการฯกับภาคประชาสังคมเมื่อวันที่ 22 พฤศจิกายน ที่ผ่านมา

มีประเด็นอะไรบ้างที่ได้รับความสนใจในที่ประชุมCERD Review?

✔️นับเป็นครั้งแรกในกระบวนการทบทวนสถานการณ์สิทธิมนุษยชนโดยสหประชาชาติของประเทศไทย ที่รัฐบาลไทยต้องตอบคำถามเกี่ยวกับการเลือกปฏิบัติต่อผู้มีเชื้อสายลาว-อีสานในประเทศไทย คณะกรรมการฯหลายท่านได้ทวงถามคำตอบจากรัฐบาลไทยในประเด็นเกี่ยวกับการเลือกปฏิบัติต่อคนอีสาน การเหยียดผิวสี นโยบายการเลือกปฏิบัติต่อคนอีสานจากภาครัฐฯ หรือแม้แต่การสื่อภาพลักษณ์ที่ไม่ดีของขาวอีสานในสื่อสิ่งพิมพ์และในสังคมไทย เช่นการเหมารวม (Stereotype) อย่างเหยียดหยาม ว่าคนอีสานคือ ‘เมียฝรั่ง’ เป็นต้น

✔️นอกจากนั้น ทางคณะกรรมการฯยังได้ถามคำถามเกี่ยวกับนโยบายและกฏหมายรักษาผืนป่าของไทย ซึ่งส่งผลกระทบอย่างไม่ธรรมต่อชุมชนในชนบทและกลุ่มชาติพันธุ์ผู้ปกป้องผืนป่า!

✔️ประเด็นการเลือกปฏิบัติแบบทับซ้อน (Intersectional Discrimination) ที่ผู้มีความหลากหลายทางเพศ (LGBTIQ+) ในกลุ่มผู้ลี้ภัยและกลุ่มชาติพันธุ์ที่มักถูกผลักให้ไปอยู่ในชายขอบของสังคมก็ได้รับความสนใจเป็นอย่างมากระหว่างการประชุมเช่นเดียวกัน

แล้วรัฐบาลไทยตอบคำถามเหล่านี้อย่างไร? 🚨 คำตอบของรัฐบาลมีแต่คำอธิบายที่ไม่ชัดเจนและข้อแก้ตัวอย่างข้างๆคูๆ หรือแม้แต่คำโกหกเพื่อปกปิดการละเมิดสิทธิมนุษยชนและการปฏิบัติต่อชนกลุ่มชายขอบในประเทศไทย แม้รัฐบาลไทยจะตระเตรียมสคริปเพื่อตอบคำถามคณะกรรมการฯในครั้งนี้ดีอย่างไร ก็ยังไม่ยอมตอบคำถามเกี่ยวกับการเลือกปฏิบัติและการเหยียดผิวสีต่อคนอีสานอยู่ดี แถมยังกล่าวหาภาคประชาสังคมว่าได้ให้ 'เฟคนิวส์' แก่คณะกรรมการฯ ซึ่งจากนี้ก็เป็นหน้าที่ของรัฐบาลแล้วที่ต้อง ‘พิสูจน์’ กับคณะกรรมการฯ ว่าข้อมูลที่เราสำเสนอไป ‘ไม่จริงตรงไหน’?

และปฏิบัติตามข้อสังเกตุเชิงสรุปจากคณะกรรมการฯในทันที!

#FightRacism 📣 Thailand's UN Human rights Review on Racial Discrimination is over! In groundbreaking interventions made by several UN experts, members of the UN Committee on the Elimination of all Forms of Racial Discrimination (CERD Committee), issues that we have long advocated for were finally addressed! ✊🏼 How did we achieve this?

📍 Since its opening in 2017, Manushya Foundation has been diligently monitoring the human rights situation on the ground and partnering with grassroots communities from all over Thailand. The UN CERD Review is a unique opportunity to amplify these #VoicesOfThailand and bring their concerns on racial discrimination to the attention of the international community.

✊🏼 Through extensive advocacy work done in our Joint Civil Society Shadow Report for Thailand's CERD Review and lobbying in Geneva prior to the review, we were able to ensure that issues that have been long ignored by the Thai Government are now at the center of attention of human rights mechanisms. During several in-person and online meetings, we presented evidence-based data and personal testimonies from the ground to the CERD Committee members who used them to hold the Thai government accountable during the review!

"Dear CERD Committee members, I implore you, urge you, to not leave Isaan people behind. It takes you now to break the taboo, to ask questions, to make concluding observations that Isaan people need, that will, I hope one day, bring Justice and equality to those who have been suffering in silence, humiliated in silence, and who have been cast for too long as criminals: simply because they are sex workers, or farmers living and protecting the forest. Dear CERD Committee members, the power is now in your hands. It’s time for Isaan people to be treated as Equal Human Beings."

Emilie Pradichit, Executive Director and Founder at Manushya Foundation, addressed the UN CERD Committee on 22 November 2021, during the informal meeting with civil society.

What were the issues addressed?

✔️ For the first-ever time at a UN human rights review, the Thai government was confronted with the truth about its treatment of the Khon Isaan ethnic group. Several Committee members raised questions regarding discrimination of the Khon Isaan, colorism, their negative portrayal in Thai media and society, including the stereotypes such as "mia farang" - "white foreigner's wife" and discrimination endorsed and spread by State actors.

✔️ The CERD Committee also addressed the issue of bad forest conservation laws and policies and false climate solutions unfairly targeting rural population and indigenous and ethnic minority persons who are Guardians of the forests!

✔️ Intersectional discrimination faced by groups such as LGBTIQ+ asylum seekers, refugees and indigenous persons who often live at the margins of their own communities.

How did the Government respond?🚨 Feeble excuses and justifications, vague or inaccurate answers and utter lies covering up its human rights violations and treatment of marginalized communities. While the Government rehearsed responses to issues that had been addressed in the last CERD review, it didn't provide answers to questions on the Khon Isaan or colorism in Thailand at all. It even blamed civil society for providing false information, 'fake news', for the review. This desperate attempt to discredit us and our data was, however, halted by the CERD Committee that prompted the Government to prove that our data is false. Of course, the Thai government was unable to do so!

🚨 We call on the Thai government to stop lying to the international community, to stop trying to save face - but instead to be held accountable, comply with its international human rights obligations and promptly implement all concluding observations that the Committee issues!
