⚠️ Laotian UNHCR-recognized asylum seeker Khoukham arrested by Thai police was finally bailed out!






(English below)🚨ข่าวด่วน ⚠️นักกิจกรรมเพื่อประชาธิปไตยชาวลาว คุค้ำ แก้วมะนีวง ที่ถูกตำรวจไทยจับแม้จะมีสถานะผู้ลี้ภัยจาก UNHCR ได้รับการประกันตัวเเล้ว!


📍เมื่อวันที่ 29 มกราคม 2565 คุค้ำ แก้วมะนี แกนนำกลุ่มเรียกร้องประชาธิปไตย “ลาวเสรี” (Free Lao) ที่ได้รับการรับรองสถานะผู้ลี้ภัยจากข้าหลวงใหญ่ผู้ลี้ภัยแห่งสหประชาชาติ UNHCR ได้ถูกตำรวจจับกุมและพาตัวไปที่ สน.ทุ่งสองห้อง คุค้ำถูกดำเนินคดีจากการอยู่เกินกำหนดระยะอนุญาต ทำให้เขามีสถานะเป็นผู้เข้าเมืองโดยผิดกฎหมาย คุค้ำถูกนำตัวมาฟ้องที่ศาลแขวงดอนเมือง เมื่อวันที่ 30 มกราคม 2565 เวลา 13:00 น. เมื่อกระบวนการพิจารณาคดีเสร็จสิ้น ตำรวจจะทำเรื่องผลักดันส่งกลับประเทศ


✨วันที่ 1 กุมภาพันธ์ 2565 คุค้ำได้รับการประกันตัวแล้ว เขาได้ให้สัมภาษณ์กับ Radio Free Asia ว่า “ได้รับการช่วยเหลือจากทนายความด้านสิทธิมนุษยชนและองค์การสหประชาชาติ” เขากล่าวถึงเงื่อนไขในการปล่อยตัวของเขาว่า “ฉันสามารถนอน อยู่และเดินทางในที่ที่กำหนดเท่านั้น และห้ามเดินทางข้ามจังหวัด”


👮🏻‍♂️คุค้ำยังกล่าวอีกว่าเขาหยุดเคลื่อนไหวทางการเมืองมานานเกิน 2 ปีแล้วหลังจากได้รับบัตรผู้ลี้ภัยของ UNHCR เนื่องจากเป็นหนึ่งในเงื่อนไขในการรับบัตร แต่มีคนไปเห็นภาพการเคลื่อนไหวของเขาในอดีตแล้วไปร้องเรียน จึงเกิดการจับกุมขึ้น


🗣“ถ้าผมจะต้องเดินทางไปประเทศที่สามตอนนี้ ผมก็จะไป แต่ถ้ามีตัวเลือกให้ผมเลือก และมีความปลอดภัยมากกว่านี้กับผมในประเทศไทย ผมก็อยากจะอยู่ที่นี่มากกว่า” คูคำกล่าว


❌การกระทำเช่นนี้ “ไม่ใช่” ครั้งแรกในประเทศไทย เมื่อวันที่ 1 ธันวาคม 2564 พระบอรบอท นักกิจกรรมการเมืองชาวกัมพูชา ซึ่งลี้ภัยและมาบวชเป็นพระสงฆ์ในไทยก็ถูกจับกุมข้าหาลักลอบเข้าเมือง แม้ว่าพระบอรบอทจะได้รับสถานะผู้ลี้ภัยของข้าหลวงใหญ่แห่งสหประชาชาติแล้วก็ตาม


🇹🇭รัฐบาลไทยนอกจากจะไม่ช่วยเหลือผู้อพยพ กลับยังซ้ำเติมพวกเขาด้วยการจับกุมและส่งพวกเขากลับประเทศที่พวกเขาหนีมาด้วยการยกข้ออ้างว่าเพราะประเทศไทยไม่ได้เป็นภาคีตาม "อนุสัญญาปี ค.ศ. 1951 ว่าด้วยสถานภาพผู้ลี้ภัย"


✊🏻มูลนิธิมนุษยะขอเรียกร้องให้รัฐบาลต้องเคารพใน "หลักการไม่ผลักดันกลับ" หรือ Non-Refoulement ซึ่งเป็นหลักการสากลและมีสถานะเป็นกฎหมายบังคับเด็ดขาดในพันธกรณีมนุษยชนระหว่างประเทศ หลักการนี้ห้ามไม่ให้รัฐใดๆผลักดันผู้ลี้ภัยกลับไปที่ที่จะเป็นอันตรายต่อชีวิตหรือเสรีภาพของพวกเขา

📍On January 29, Khoukham Keomanivong, a Laotian leader of the pro-democracy group Free Lao who is a UNHCR-recognized asylum seeker, was arrested by Thai police and brought to Thug Song Hong police station. He was charged with overstaying his permission to be in the country and illegal migration. He was tried at the Don Mueang district court on January 30 at 1 pm. After the legal procedures are concluded, the police plan to deport him back to Laos.


✨On February 1, 2022, Khoukham was bailed out. Speaking to Radio Free Asia, he said that “I’ve been bailed out with the help of a human rights lawyer and the U.N.”. His release is subject to strict conditions, including movement restrictions, but no details are currently known.


👮🏻‍♂️ Khoukham stopped his political activities more than two years ago in order to be able to receive his UNHCR card. However, his older political content was discovered on the Internet and reported which led to his arrest.


🗣 “If I now have to go to a third country, I’ll go. But if I’m given a choice, and if there’s more security for me here in Thailand, I’d prefer to stay here,” he said.


❌ The case of Khoukham is NOT the first one in Thailand. On December 1 in 2021, Buddhist monk Bor Bet who had also sought asylum and become a Buddhist monk in Thailand was arrested on a charge of being an illegal immigrant although he had already been granted the status of asylum seeker by the UNHCR.


🇹🇭 The Thai government does not help asylum seekers and puts them in danger by arresting and deporting them to the country they had tried to escape. The Government's excuse of not being a signatory to the 1951 Convention Relating to The Status of Refugees? Not applicable! Thailand MUST respect the sacrosanct principle of non-refoulement which forbids it from deporting asylum seekers to a country where their lives might be in danger! And as a former political activist, Khoukham will face torture and imprisonment if returned to Laos!

✊🏻Manushya Foundation calls on the Government of Thailand not to deport Khoukham back to Laos! The Government must adhere to International Law and protect his human rights!
