#Thailand #สมรสเท่าเทียม #1448forall #MarriageEquality 🚨 หลังจากศาลรัฐธรรมนูญออกคำวินิจฉัยที่ยังไม่เปิดโอกาสให้คนเพศเดียวกันจดทะเบียนสมรสได้เหมือนคู่ชายหญิงไปในช่วงกลางเดือนพ.ย. #ม็อบสมรสเท่าเทียม ได้เปลี่ยนแยกราชประสงค์ กรุงเทพฯ ให้กลายเป็นสีรุ้งในวันอาทิตย์ที่ผ่านมาเพื่อยืนยันว่า ‘ความรัก ยังไงก็คือความรัก’ ไม่ว่าคุณจะเลือกเป็นเพศไหนก็ตาม! 🏳️‍🌈

⚠️ เมื่อวันที่ 17 พฤศจิกายนที่ผ่านมา ศาลรัฐธรรมนูญออกคำตัดสินด้วยมติเอกฉันท์ว่าประมวลกฎหมายแพ่งและพาณิชย์ #มาตรา1448 ซึ่งรับรองสมรสแค่ระหว่างชายและหญิง “ไม่ขัดหรือแย้งต่อรัฐธรรมนูญ”

📍 แม้ว่ากระทรวงยุติธรรมว่าจะเร่งเสนอร่างพระราชบัญญัติคู่ชีวิตเป็นกฏหมายแยก แต่การออกกฏหมายแยกไม่ใช่สิ่งที่เราต้องการ! ❌ เพราะพรบ.ฉบับดังกล่าวไม่ได้รับรองสิทธิกลุ่มLGBTIอย่างเท่าเทียมภายใต้รัฐธรรมนูญเดียวกัน ไม่ว่าจะเป็นสิทธิในการสร้างครอบครัว สิทธิในทรัพย์สิน ฯลฯ หากไทยต้องการการสมรสที่เท่าเทียมอย่างแท้จริง ไทยต้องแก้ประมวลกฏหมายแพ่งและพาณิชย์ โดยเฉพาะ #มาตรา1448 ให้เป็นคำที่เป็นกลางทางเพศ (Gender-neutral) เช่น แก้ไขคำว่าการสมรสระหว่าง "ชายและหญิง" มาเป็นคำว่า "บุคคลต่อบุคคล" เป็นต้น!

🌈 เราเชื่อว่ามนุษย์ทุกคน ‘เท่ากัน’ และสิทธิการสมรสคือ ‘สิทธิมนุษยชน’ ไม่ใช่ ‘สิทธิพิเศษ’ สำหรับแค่คู่รักต่างเพศเท่านั้น แม้ศาลฯและรัฐบาลไทยจะไม่เชื่อเช่นนั้นก็ตาม การต่อสู้ของพวกเราเพื่อ #สมรสเท่าเทียม จึงต้องไม่หยุดเพียงเท่านี้! เราขอเชิญชวนให้ทุกคนร่วมเข้าชื่อเพื่อนำเสนอร่างกฎหมายสมรสเท่าเทียมภาคประชาชนเพื่อแก้ #มาตรา1448 และมาตราอื่นๆที่เกี่ยวข้องในบรรพ 5 และ 6 ของประมวลกฎหมายแพ่งและพาณิชย์ได้ที่นี่ www.support1448.org

⚠️ On 17 November 2021, the Constitutional Court of Thailand disappointed the whole nation by ruling that Section 1448 of Civil and Commercial Code, which recognizes only marriages between men and women “does not contravene the Constitution”

📍 Although the Ministry of Justice was quick to announce that they are working to pursue a civil partnership bill, it is not the answer we are looking for! ❌ The Civil Partnership Bill would not recognize LGBTI people as equal human beings under the same Constitution, as it does not guarantee equal rights when it comes to family rights, property rights, and many more! For a true #MarriageEquality, Thailand must amend Section 1448 to adopt gender-neutral language, using, for example, wordings like 'the marriage between a person and person' instead of that between 'man and woman'!

🌈 Marriage is a human right, not a heterosexual privilege! Although the Court and the Government of Thailand do not believe so, we do and we know you do too!
