(English below)✊🏻#Saveบางกลอย is POSSIBLE with the POWER OF PEOPLE! 🎉เเม้ว่าจะถูกขัดขวางโดยตำรวจควบคุมฝูงชน ภาคี #Saveบางกลอย และขบวนการประชาชนเพื่อสังคมที่เป็นธรรม (P-Move) นำโดยชุมชนบางกลอยกดดันให้รัฐบาลเห็นชอบแนวทางการแก้ปัญหาตามข้อเสนอได้สำเร็จ!


📍หลังจากที่หนังสือของชุมชนกะเหรี่ยงบ้านบางกลอย อำเภอแก่งกระจาน จังหวัดเพชรบุรีที่ยื่นถึงนายกรัฐมนตรีตั้งแต่วันที่ 14 ธันวาคม 2564 ยังไม่มีความคืบหน้าใดๆ เมื่อวาน (วันที่ 1 กุมภาพันธ์ 2565) ภาคี #Saveบางกลอย เเละขบวนการประชาชนเพื่อสังคมที่เป็นธรรม (P-Move) ได้เดินทางไปที่หน้าทำเนียบรัฐบาลเพื่อเรียกร้องให้รัฐบาลแก้ไขปัญหาเชิงโครงสร้าง แทนที่จะแก้ปัญหาเป็นกรณี


👮🏻‍♂️แม้ว่าการต่อสู้เพื่อเรียกร้องให้มีการตรวจสอบข้อเท็จจริงและแก้ไขปัญหาของชุมชนกะเหรี่ยงบ้านบางกลอยจะเต็มไปด้วยอุปสรรคจากการเพิกเฉยเเละการผลักความรับผิดชอบของเจ้าหนัาที่ รวมไปถึงการขัดขวางการเข้าถึงผู้ที่มีอำนาจในการตัดสินใจด้วยตู้คอนเทนเนอร์ โล่และลวดหนามจากตำรวจควบคุมฝูงชน และการบังคับใช้พ.ร.บ.ควบคุมโรคติดต่อ แต่สุดท้ายนายธัชพงศ์ แกดำและพชร คำชำนาญ ตัวแทนจาก P-Move และภาคี Save บางกลอยก็ได้เข้าไปยื่นหนังสือและเจรจา


💪🏻ในที่สุดคณะรัฐมนตรีก็เห็นชอบแนวทางการแก้ปัญหาของ P-Move ซึ่งมีประเด็นที่เกี่ยวข้องกับชุมชนกะเหรี่ยงบ้านบางกลอยดังนี้

1. มอบหมายคณะอนุกรรมการแก้ไขปัญหาคดีความกฎหมาย และกระบวนการยุติธรรม คณะทำงานจะศึกษาร่างกฎหมายว่าด้วยการนิรโทษกรรมแก่ราษฎรซึ่งได้รับความเสียหายหรือได้รับผลกระทบจากการดำเนินการตามนโยบายของรัฐ

2. มอบหมายให้รัฐมนตรีประจำสำนักนายกรัฐมนตรีเเละรองประธานกรรมการแก้ไขปัญหานำเสนอของ P-Move ไปหารือกับรัฐมนตรีว่าการกระทรวงทรัพยากรธรรมชาติและสิ่งแวดล้อม เพื่อไปรับพิจารณาแนวทางการดำเนินการในการทบทวนพระราชบัญญัติ เช่น ร่างกฎหมายลำดับรองประกอบพระราชบัญญัติอุทยานแห่งชาติ พ.ศ.2562

3.มอบหมายให้คณะอนุกรรมการแก้ไขปัญหาความมั่นคงในที่อยู่อาศัย พื้นที่ทำกินและพื้นที่ทางจิตวิญญาณของกลุ่มชาติพันธุ์ชาวกะเหรี่ยง

4.มอบหมายฝ่ายเลขานุการจัดทำร่างคำสั่งแต่งตั้งคณะกรรมการขับเคลื่อนฟื้นฟูวิถีชีวิตกลุ่มชาติพันธุ์ชาวกะเหรี่ยง ร่วมกับ P-Move และนำเสนอต่อนายกรัฐมนตรีเพื่อพิจารณาต่อไป


⚠️ แต่เราจะไม่หยุดเพียงเท่านี้ การได้รับความเห็นชอบจากคณะรัฐมนตรีไม่ถือเป็นชัยชนะที่แท้จริง! รัฐบาลไทยต้องไม่รับปากเพียงเพื่อซื้อเวลาและหันเหความสนใจของสื่อมวลชน! ถึงเวลาแล้วที่รัฐบาลไทยจะต้องปฏิบัติตามพันธกรณีสิทธิมนุษยชนระหว่างประเทศ โดยเฉพาะอนุสัญญาว่าด้วยการขจัดการเลือกปฏิบัติทางเชื้อชาติ 💖มูลนิธิมนุษยะขอยืนเคียงข้างชาวบางกลอย ภาคี Save บางกลอย กลุ่มบางกลอยคืนถิ่น และ P-Move ในการยืนหยัดต่อสู้เพื่อสิทธิมนุษยชนของ “ทุกคน” #ชาติพันธุ์ก็คือคน!

🎉After being stopped by anti-riot police, the community-led #SaveBangkloi Coalition and P-Move successfully pressure the Government to agree on their proposed solution!


📍Since there was no response from the Government after the letter from the Bangkloi indigenous community to the Prime Minister on December 14, 2021, this Tuesday, February 1, the #SaveBangkloi Coalition and P-Moved marched in front of the Government House of Thailand. The community-led groups demanded the Government to truly solve the overdue structural problem instead of giving them hollow and short-term solutions regarding the rights of Bangkloi indigenous community.


👮🏻‍♂️Indeed, the attempts to demand the investigation and solution of the situation of the community have been encountered with various obstacles ranging from ignoring the issue to shifting the responsibility by the authorities. On Tuesday, the authorities also tried to physically stop the villagers from demanding their rights and having access to the decision-makers with barricades and razor wire and invoking the Communicable Diseases Act 2015. However, Touchapong Kaedum and Pachara Kumchumnan, representatives of P-Move and the #SaveBangkloi Coalition, were finally allowed to deliver the letter containing the community demands and negotiate.


💪🏻 Eventually, the Cabinet approved the proposal from the P-Move and agreed on their 15 demands, including:


✔️ Assign a committee to resolve legal issues concerning the Bangkloi community. The committee will work on a draft of an amnesty law for the persons who have been found guilty based on the government policies.


✔️ To bring the proposal by the P-Move to the Minister of Natural Resources and Environment in order to consider revision of directives such as ministerial regulations related to the National Park Act 2562 (2019).


✔️ Assign a subcommittee to resolve the issue of lacking residential areas, arable land, and spiritual spaces of the indigenous Karen community.


✔️ Prepare a draft of an order establishing a committee to work with P-Move that would push for the revival of the way of life of the indigenous Karen community and propose the draft to the Prime Minister for further consideration.


⚠️ But, we will not stop here. We do not take this as a conclusive victory! The Thai government MUST NOT give its word just to buy more time and defuse the media buzz! NOW is time for the Thai government to live up to the obligations before international human rights law, especially the International Convention on the Elimination of All Forms of Racial Discrimination (ICERD) and concluding observations of the CERD review last year.
