#SaveNittaya Her Fight For Justice Is Not Over!

The Sai Thong National Park Case isn’t over! Nittaya still has one case against her tomorrow, as she is wrongly accused of destroying the Forest for her sustainable agriculture of crops! The other 13 villagers also have their Supreme Court’s Verdicts delivered this month! #SaveNittaya #SaveSabwaiVillagers

Watch the video as Nittaya shares with us the unfair criminalization the 14 Sab Wai villagers are facing, and her journey in fighting back the unjust application of Thailand’s Forest Reclamation Policy. In this video, Nittaya denounces the difficult access to the justice system for poor villagers like her and her friends. Back then in 2016, they didn’t know their rights and how to seek justice. The worst was they lacked financial support to fight for themselves.

But now through their experience and support from Manushya Foundation, they know what to do, which law would protect them, what rights they have in defending themselves, and where to go for support. Nittaya wants everyone, not just her community members, to gain this knowledge! Since then, she has been working hard to share this knowledge with other communities facing injustice and criminalization because of Thailand’s bad Forest Reclamation Policy. She is also working hard to change forest-related laws to be more grounded in reality, reflecting and respecting the lives of forest-dependent communities.

คดีอุทยานแห่งชาติไทรทองยังไม่สิ้นสุด! ศาลจะอ่านคำพิพากษาศาลฎีกาในคดีที่สองของนิตยาและชาวบ้านซับหวายอีก 13 คน ในเดือนนี้แล้ว! โดยคดีที่สองของนิตยาในวันพรุ่งนี้คือคดีทำลายป่าทั้งที่นิตยาแค่ทำไร่หมุนเวียน! #Saveนิตยา #Saveชาวบ้านซับหวาย

ในวิดีโอนี้ นิตยาได้แบ่งปันและเล่าถึงประสบการณ์การต่อสู้กับการบังคับใช้นโยบายทวงคืนผืนป่าอย่างไม่เป็นธรรมซึ่งทำให้ชาวบ้านซับหวายทั้ง 14 คนต้องกลายเป็นอาชญากรเพียงแค่เพราะพวกเขาใช้ที่ดินของตัวเองในการหาเลี้ยงชีพ โดยนิตยากล่าวว่าอุปสรรคที่คนยากคนจนต้องเผชิญเมื่อต้องสู้คดีในศาลก็คือการที่ไม่สามารถเข้าถึงกระบวนการยุติธรรม ในช่วงต้นของคดี ปี 2559 นิตยาและชาวบ้านคนอื่นๆ ในชุมชนต่างก็ไม่มีใครมีความรู้เรื่องกฎหมาย ไม่รู้ว่ากระบวนการยุติธรรมมีกลไกและทำงานอย่างไร ไม่ได้ตระหนักว่าตนเองมีสิทธิอะไร และที่แย่ที่สุดคือไม่มีแม้แต่เงินทุนที่จะใช้ในการต่อสู้คดี

แต่จากประสบการณ์ทั้งหมดที่ผ่านมาและการสนับสนุนจากมูลนิธิมานุษยะ ชุมชนได้เรียนรู้แล้วว่าเมื่อต้องสู้คดี จะต้องทำอย่างไร ไปที่ไหน มีกฎหมายและสิทธิใดบ้างที่จะสามารถคุ้มครองพวกเขาได้ นิตยามองว่าข้อมูลที่ได้รับเหล่านี้เป็นชุดความรู้ที่สำคัญและมีคุณค่าที่ทุกคนควรตระหนักถึง ไม่ใช่เพียงแค่ชุมชนซับหวายเท่านั้นเท่านั้น นิตยาจึงได้เริ่มแบ่งปันและบอกเล่าถึงประสบการณ์และความรู้ที่เป็ประโยชน์ให้กับชุมชนต่างๆ ที่กำลังเผชิญปัญหาในลักษณะเดียวกัน อีกทั้งยังได้พยายามอย่างหนักเพื่อผลักดันให้เกิดการเปลี่ยนแปลงกฎหมายป่าไม้ให้มีความสอดคล้องกับสภาพความเป็นจริงและความเป็นอยู่ของชุมชนที่ต้องพึ่งพิงป่าให้มากยิ่งขึ้น
