#SaveSompitr This a story of true injustice in Thailand, putting poor people in jail, while protecting the 1% Rich

The people lost yesterday as the Thai Supreme Court sentenced Sompitr Taennok to 20 months and 20 days of jail! On May 11, 2021, the court found Sompitr guilty of encroaching and destroying the forest in Sai Thong National Park area despite the fact that he and his family had been living there before the area was declared a national park.

Like Nittaya and other Sab Wai Villagers, Sompitr is being unfairly criminalized, found guilty of encroaching and destroying the forest due to the bad implementation of Thailand’s Forest Reclamation Policy. The policy initially aimed to increase the forest area by taking the forest back from big business operations and rich investors. So why are poor villagers like Sompitr the ones being targeted and jailed?

For many years, the Sab Wai villagers have been fighting for justice and their right to peacefully live and cultivate sustainable crops on the land in court. Sompitr has already spent time in jail for months in 2019, due to the Court of Appeal’s verdict, before we could bail him out. We had hoped that the Supreme Court would see he did nothing wrong and he wouldn’t have to go back to jail. But that is not the case today.

Yesterday, Sompitr was sent to jail immediately. He did not have any time to say goodbye to his family, to his loving wife fighting to survive as she’s very sick with a stage 4 cancer and wasn’t able to travel to the court with him for his verdict hearing.

This is #WhatsHappeningInThailand , the poor villager is being put in jail instead of the investor! Because of the unjust law that does not put poor people from the ground at the center of any laws that affect them! The military-backed government keeps on ignoring marginalized communities’ voices and pass laws that create inequality, injustice while protecting the Rich, the 1%, the investors and we all know WHO is at the top of this unfair pyramid!

Manushya Foundation and the villagers will continue to fight to #SaveSompitr from jail! We will submit a letter to the Supreme Court requesting for him to be pardoned. And we will use international litigation to fight back until all the Sab Wai villagers get the remedy they deserve for all the injustice and damage done to them!

#Saveสมพิตร นี่คือเรื่องราวความอยุติธรรมในประเทศไทย ที่คุกมีไว้เพื่อขังคนจน แต่คนรวย 1 % บนยอดพีรามิดทำอะไรก็ไม่ผิด

ความพ่ายแพ้ของประชาชน! 11 พ.ค. 2564 - ศาลฎีกามีคำพิพากษาจำคุกลุงสมพิตร แท่นนอกนานถึง 20 เดือนกับอีก 20 วัน! โดยศาลฎีกาตัดสินว่าลุงสมพิตรกระทำผิดฐานบุกรุกและทำลายป่าในเขตอุทยานแห่งชาติไทรทองจากการเข้าไปอยู่อาศัยและทำไร่ในพื้นที่ ทั้งที่ความเป็นจริงลุงสมพิตรและครอบครัวอยู่ในพื้นที่มาตั้งแต่ก่อนจะประกาศเป็นเขตอุทยานแห่งชาติซะอีก!

เช่นเดียวกับพี่กบ นิตยาและชาวบ้านซับหวายคนอื่นๆ ลุงสมพิตรถูกดำเนินคดีอาญาด้วยข้อหาบุกรุกและทำลายป่า ซึ่งเป็นผลมาจากนโยบายทวงคืนผืนป่าของคสช. ซึ่งมีจุดประสงค์เพื่อเพิ่มพื้นที่ป่าโดยทวงคืนป่าจากนายทุนและธุรกิจขนาดใหญ่ ซึ่งก็น่าแปลกใจว่าชาวบ้านอย่างลุงสมพิตรนับเป็นนายทุนด้วยหรือ ทำไมถึงถูกดำเนินคดีจนถึงขั้นติดคุก

หลายปีมานี้ชาวบ้านซับหวายได้สู้คดีมาจนถึงชั้นศาลฎีกาเพื่อทวงสิทธิในที่ทำกินของตัวเองคืน และลุงสมพิตรก็เคยต้องติดคุกไปแล้วจากคำพิพากษาศาลอุทธรณ์ในปี 2562 ก่อนจะได้ประกันตัวออกมาสู้คดีในชั้นศาลฎีกา ซึ่งทุกคนก็ได้แต่หวังว่า คำพิพากษาศาลฎีกาจะทำให้ลุงสมพิตรจะไม่ต้องกลับไปติดคุกอีก แต่สุดท้าย ความหวังก็เป็นได้แค่ความหวัง

เมื่อเย็นที่ผ่านมา ลุงสมพิตรถูกส่งตัวเข้าเรือนจำทันที โดยไม่มีแม้แต่โอกาสที่จะได้บอกลาภรรยาที่กำลังป่วยเป็นมะเร็งระยะสุดท้าย อาการหนักจนไม่สามารถเดินทางมาฟังคำพิพากษาพร้อมกับลุงได้

นี่แหละ #WhatsHappeningInThailand ประเทศที่คนจนติดคุกแต่คนรวยรอด เพราะกฎหมายไม่ตั้งอยู่บนหลักความจริงและไม่เห็นหัวประชาชน รัฐบาลที่มีกองทัพหนุนหลังได้ละเลยกลุ่มคนชายขอบในประเทศมาโดยตลอด ออกกฎหมายมาแต่ละอย่างมีแต่จะขยายช่องว่างความไม่เท่าเทียม ความอยุติธรรม ปกป้องแค่คนรวย 1% ของประชากรเท่านั้น ปกป้องแค่นายทุนและอีลีทบนยอดพีรามิด

ทางมูลนิธิมานุษยะและชาวบ้านจะร่วมมือกันต่อสู้ในทางกฎหมายต่อไป เพื่อขอให้ลุงสมพิตรได้รับการอภัยโทษ #Saveสมพิตร และใช้กลไกสิทธิมนุษยชนระหว่างประเทศกดดันรัฐบาลเพื่อให้ชดเชยความเสียหายที่เกิดขึ้นกับชีวิตชาวบ้านซับหวายทุกคน
