The World Must Know: a huge backslide in the fight for LGBTIQ+ rights

โลกต้องรู้! เมื่อประเทศไทยกำลังก้าวถอยหลัง #สมรสเท่าเทียม

#Thailand 🚨 อีกหนึ่งข่าวที่น่าผิดหวังในอาทิตย์นี้ เมื่อการต่อสู้เพื่อสิทธิที่เท่าเทียมของกลุ่ม LGBTIQ+ ในประเทศไทยกำลังก้าวหน้าอย่างต่อเนื่องในปีที่ผ่านมา 🏳️‍🌈 ศาลรัฐธรรมนูญไทยกลับนำพาประเทศไทยก้าวถอยหลังอีกครั้ง

📍 เมื่อวันที่ 17 พฤศจิกายนที่ผ่านมา ศาลรัฐธรรมนูญออกคำตัดสินด้วยมติเอกฉันท์ว่าประมวลกฎหมายแพ่งและพาณิชย์ #มาตรา1448 ซึ่งรับรองสมรสแค่ระหว่างชายและหญิง “ไม่ขัดหรือแย้งต่อรัฐธรรมนูญ” มติศาลรัฐธรรมนูญครั้งนี้ถือเป็นการก้าวถอยหลังครั้งสำคัญสำหรับการต่อสู้เพื่อการรับรองทางกฏหมายของการสมรสระหว่างเพศเดียวกันและสิทธิที่เท่าเทียมกันของกลุ่ม LGBTIQ+ ในประเทศไทย

📣”กลุ่มผู้มีความหลากหลายทางเพศในประเทศไทยย่อมมีสิทธิที่จะสมรสและสร้างครอบครัวกับคนที่พวกเขารักเฉกเช่นเดียวกับคนทั่วไป แทนที่จะออกคำตัดสินอันล้าหลังราวกับออกมาจากยุคไดโนเสาร์เช่นนี้ รัฐไทยควรจะต้องเดินหน้าออกฏหมายรับรองการสมรสระหว่างเพศเดียวกัน และทำหน้าที่ปกป้องและส่งเสริมสิทธิของกลุ่มLGBTIให้ทัดเทียมเสมอภาค เพราะผู้มีความหลากหลายทางเพศคือ ‘มนุษย์ที่เท่ากัน’ ไม่มีใครต่ำไปกว่านั้นเลย” Emilie Pradichit ผู้ก่อตั้งและผู้บริหารมูลนิธิมานุษยะ กล่าว

🚨 แม้ว่ากระทรวงยุติธรรมจะเร่งเสนอร่างร่างพระราชบัญญัติคู่ชีวิตเป็นกฏหมายแยก แต่พรบ.ดังกล่าวไม่ได้รับรองสิทธิกลุ่มLGBTIอย่างเท่าเทียมแต่อย่างใด ไม่ว่าจะเป็นสิทธิในการสร้างครอบครัว สิทธิในทรัพย์สิน ฯลฯ ทำให้กลุ่มLGBTIกลายเป็นพลเมืองชั้นสองภายใต้รัฐธรรมนูญเดียวกัน เราได้แต่เพียงหวังว่าประชาคมโลกจะไม่สรรเสริญร่างพรบ.คู่ชีวิตนี้ว่าเป็นความก้าวหน้าในการปกป้องสิทธิมนุษยชนของไทย พรบ.ร่างนี้ไม่ใช่ความก้าวหน้า แต่เป็นเพียงกฏหมายที่รับรอง ‘Second-class Treatment’ ต่อกลุ่มLGBTI เท่านั้น ซึ่งเป็นสิ่งที่ ‘ไม่ถูกต้อง ไม่เป็นธรรม และ ไร้มนุษยธรรม’

แต่การต่อสู้เพื่อสิทธิกลุ่มLGBTIQ+จะไม่หยุดแต่เพียงเท่านี้! ✊🏼

คำตัดสินศาลรัฐธรรมนูญครั้งนี้มาพร้อมกับความกดดันจากนานาชาติบนเวทีUniversal Periodic Review (UPR) แห่งสหประชาชาติ ครั้งที่3ของประเทศไทย ซึ่งรัฐบาลไทยได้รับข้อแนะนำ (Recommendation) ถึง 12 ข้อ เกี่ยวกับสิทธิกลุ่ม LGBTIQ+ โดยมีถึง 4 ข้อที่จี้ให้ดำเนินการแก้ไขมาตรา 1448 ของประมวลกฏหมายแพ่งและพาณิชย์เพื่อรับรองการสมรสระหว่างเพศเดียวกัน แม้รัฐบาลไทยยังไม่แสดงท่าทีชัดเจนว่าจะรับข้อแนะนำดังกล่าวไปปฏิบัติหรือไม่ แต่สิ่งที่แน่นอนก็คือ… ประชาคมโลกกำลังจับตามองอยู่!

#Thailand 🚨 Another week, another shocking news. This time, the Constitutional Court of Thailand reverted much progress that has been made in 🏳️‍🌈 LGBTIQ+ rights advocacy in the past years. What happened?

📍 On 17 November, the Constitutional Court decided that Section 1448 of the Civil and Commercial Code is not unconstitutional, even though it only determines marriage as a union between a man and a woman. The ruling marks a HUGE backsliding for our fight towards the recognition of same-sex marriage and the equal rights of the LGBTIQ+ community in Thailand.

📣 "LGBTI people must have the right to marry like any other human being; it’s about equal rights and family rights. Instead of another shocking ruling by the Constitutional Court of dinosaurs, Thai authorities must legally recognize and protect LGBTI people to ensure they enjoy equal rights as Equal Human Beings, nothing less." Emilie Pradichit, our Founder and Executive Director said.

🚨 As we expected, the Ministry of Justice is now trying to pursue their civil partnership bill, but how is this Bill recognizing LGBTI people as equal human beings? It doesn’t guarantee equal rights in terms of family rights, property rights, and much more. This Bill does not recognize LGBTI people as Equal Human Beings under the Constitution. It’s still a second-class treatment. We hope international actors will not praise the Thai government by seeing this as progress. It is not progress, it is simply telling us LGBTI people should be happy with a second-class treatment. This is wrong, unfair, and inhumane.

The Fight is Not Over! ✊🏼

The Constitutional Court verdict came in a time of rising pressure from the international community. During its 3rd UPR review, Thailand received 12 recommendations on LGBTIQ+ rights, including 4 recommendations to amend section 1448 of the Civil and Commercial Code to recognize same-sex marriage. It is not clear yet if Thailand decides to accept these recommendations but one thing is sure: the World is watching!
