#WorldHealthDay Access to Health Service for All!

#WorldHealthDay “Sex workers get sick from work... but we have to take care of ourselves on our own because the work that we do is illegal in Thailand. Since we are not recognized as workers protected under labour law, we are not allowed to access healthcare services. By criminalizing us, the Thai Government is violating our fundamental right to health! This injustice has to stop! On World Health Day I urge Thai authorities to decriminalize sex work and to guarantee our equal access to health services” - Sirisak Chited

As Sirisak rightly said, it is our fundamental right to access the highest attainable standard of health according to the WHO Constitution (1946), the Universal Declaration of Human Rights (1948) and the International Covenant on Economic, Social & Cultural Rights (1966).

So, on this World Health Day, we fight to make the #RightToHealth accessible for all! Our health and the health of those we care about is a matter of daily concern. Regardless of our age, gender, socio-economic or ethnic background, health is our most basic and essential asset! Our physical and mental health are a crucial way to improve our overall well-being and achieve equality and inner peace.

Today, Manushya Foundation urges the Thai government to guarantee access to health service to everyone equally! No more leaving people behind just because the government and society deems their jobs ‘wrong’ or ‘unworthy’! Our Right to Health is not a privilege! The government cannot just decide to provide health services to one group and deny another. It is not their job to do so. But it is the government’s responsibility and obligation to ensure every single one of their citizens can access quality health services and achieve good health and well-being!

“กลุ่มผู้ค้าบริการทางเพศเจ็บป่วยจากการทำงาน แต่เราต้องดูแลตัวเองเพราะงานที่เราทำยังผิดกฎหมายในประเทศไทย เนื่องจากเราไม่ได้รับพิจารณาในฐานะลูกจ้างที่ได้รับความคุ้มครองภายใต้กฎหมายแรงงาน เราจึงไม่สามารถเข้าถึงสิทธิบริการสุขอนามัยต่าง ๆ ได้ การที่กฎหมายกำหนดให้อาชีพของพวกเราเป็นความทางอาญาเท่ากับว่ารัฐบาลไทยได้ละเมิดสิทธิขั้นพื้นฐานด้านสุขภาพ ถึงเวลาแล้วที่ต้องยุติความไม่เป็นธรรมนี้ต่อพวกเรา เนื่องในวันอนามัยโลกเราขอเรียกร้องให้รัฐบาลไทยยกเลิกความผิดทางอาญาต่ออาชีพพนักงานบริการ และให้การรับรองในการเข้าถึงบริการด้านสุขภาพอย่างเท่าเทียม”

อย่างที่ศิริศักดิ์ได้กล่าวไไป สิทธิด้านสุขภาพเป็นสิทธิขั้นพื้นฐานของมนุษย์ทุกคนตามที่ได้ประกาศไว้ในธรรมนูญองค์การอนามัยโลก ปฏิญญาสากลว่าด้วยสิทธิมนุษยชนและกติการะหว่างประเทศว่าด้วยสิทธิทางเศรษฐกิจ สังคม และวัฒนธรรม

และในโอกาสที่วันนี้เป็นวันอนามัยโลก เราขอย้ำอีกครั้งว่าทุกคนต้องสามารถเข้าถึงบริการทางสุขภาพได้และทุกคนต้องมีสิทธิในสุขภาพที่ดี สุขภาพเป็นเรื่องใหญ่สำหรับทุกคน ไม่ว่าจะอายุเท่าไร เพศอะไร ทำงานอะไร รวยหรือจน สุขภาพเป็นเรื่องพื้นฐานและเป็นหนึ่งในสิ่งที่สำคัญที่สุดของทุกคน การมีสุขภาพที่ดีทั้งกายและใจเป็นปัจจัยสำคัญที่จะช่วยให้ทุกคนมีคุณภาพชีวิตที่ดีขึ้นได้ ที่สำคัญกว่านั้น ถ้าแม้แต่เรื่องพื้นฐานอย่างสุขภาพ เรายังไม่เท่าเทียมกัน แล้วเราจะสร้างความเท่าเทียมในสังคมได้อย่างไร

มูลนิธิมานุษยะขอเรียกร้องให้รัฐบาลไทยรับรองการเข้าถึงบริการด้านสุขภาพอย่างเท่าเทียมสำหรับประชาชนทุกคน! ทางภาครัฐไม่มีหน้าที่เลือกว่าจะให้บริการใครหรือไม่ให้บริการใคร รัฐไม่สามารถปฏิเสธสิทธิในการเข้าถึงบริการด้านสุขภาพของคนบางกลุ่มได้เพียงเพราะรัฐและสังคมตีตราว่างานที่พวกเขาทำนั้นมัน ‘ผิด’ หรือไม่มีคุณค่ามากพอ แต่หน้าที่ของรัฐคือการประกันว่าประชาชนจะต้องเข้าถึงบริการทางสุขภาพได้อย่างทั่วหน้าและมีสุขภาพที่ดีได้อย่างเท่าเทียม!
